Lasting power of attorney
Legal Futures and Today's Wills and Probate both cover our response to the lasting power of attorney consultation.
"Our overarching concern is the consultation fails to address how the proposals will work for those who cannot access a digital service; nor does it address the need to ensure that the role of the certificate provider works within a digital process as was intended when the Mental Capacity Act 2005 was passed," said Law Society president I. Stephanie Boyce.

Nightingale Courts
The cost of and use of Nightingale Courts is scrutinised in the Times (£) following a freedom of information request (FOI).
"Nightingale courts were much needed to address the capacity problem resulting from the Covid-19 pandemic, and still have a role to play, so it is alarming to see such facilities seemingly underused when the backlog means victims, witnesses and defendants are waiting years to access justice," said I. Stephanie Boyce.
"With the easing of pandemic restrictions, physical court space is now less of a problem, but we are seeing the ability to run criminal courts at capacity hit by a lack of judges, court staff, advocates and litigators."

Japanese knotweed
The Express, Inside Conveyancing and Brinkwire all mention our TA6 form in pieces that report misrepresentation cases involving Japanese knotweed are on the rise.
Such cases arise when a seller has failed to declare the presence of Japanese knotweed on their property and the buyer has found it on their property after the sale was completed.
